利用規約（仮）

本規約は、当サイトに掲載する作品の利用および、管理人「ぺろ」へのイラスト制作依頼に関する基本事項を定めるものです。現在は公開前の仮規約であり、内容を調整する場合があります。
01掲載作品について
- 当サイトに掲載しているイラスト、文章、キャラクター、ロゴ等の著作権は、管理人または各権利者に帰属します。
- 個人の端末で閲覧するための保存、および当サイトのURLを共有することは可能です。
- 無断転載、再配布、複製販売、自作発言、トレース、署名や透かしの削除、許可のない加工・改変を禁止します。
- NFT・暗号資産関連での利用、素材集やデータ集への収録、商標・意匠等の登録を禁止します。
- 政治・宗教活動、誹謗中傷、違法行為、公序良俗に反する目的での利用を禁止します。
- ファンアート等、第三者が権利を有する題材については、原作および各権利者のガイドラインもあわせて適用されます。
02生成AIでの利用について
- 当サイトの作品を、生成AIの学習データ、データセット、ファインチューニング、LoRA等の追加学習に使用することを禁止します。
- 作品を画像生成AIへ入力し、image-to-image、ControlNet、参照画像、AIによる加筆・変換・類似作品の生成等に使用することを禁止します。
- 自動収集プログラム等を用いた、AI利用を目的とする画像・文章の収集を禁止します。
- 個別に許諾を得た場合は、合意した目的と範囲に限り利用できます。
03コミッションについて
- Skeb等の外部サービスを通したご依頼には、各サービスの規約・取引条件が優先して適用されます。
- メール等による直接のご依頼では、見積書、確認メールその他の個別合意が本規約に優先します。
- 制作内容、料金、納期、使用目的、修正回数等を双方で確認し、必要な支払いが完了した時点で正式受注とします。
- ご依頼者は、提供する資料や題材について、制作に必要な権利・許諾を有していることをご確認ください。
- 修正は事前に合意した回数と範囲で対応します。大幅な描き直しや受注後の仕様変更には追加料金が発生する場合があります。
- 制作着手後のご依頼者都合によるキャンセル・返金は、進行状況に応じてお受けできない場合があります。制作者側の事情で完遂できない場合は、未制作分を基準に個別対応します。
- 著作権は、書面等で譲渡を合意した場合を除き、制作者に帰属します。商用利用、二次利用、グッズ化、配信・広告等への使用は事前に用途をご相談ください。
- 納品物の改変、再配布、転売、自作発言、生成AIへの利用は、個別に許可した場合を除き禁止します。
- 制作実績として当サイトやSNS等へ掲載する場合があります。公開不可・公開時期の指定がある場合は、ご依頼前にお知らせください。
- 編集可能な元データや制作途中のデータは、事前に合意した場合を除き納品物に含みません。
04免責・規約の変更
- 当サイトから移動した外部サイトの内容、安全性、サービス継続等について、当サイトは責任を負いません。
- 当サイトは予告なく内容の変更、公開の中断・終了を行う場合があります。
- 本規約は必要に応じて変更します。変更後の内容は、当ページへの掲載時から適用します。
- 個別のご相談や利用可否の確認は、上部のお問い合わせ先からご連絡ください。

These terms set out the basic rules governing the use of works published on this website and illustration commissions requested from the administrator, Pero. They are provisional terms prepared before the site's official release and may be revised.
01Published Works
- Copyright in the illustrations, written content, characters, logos, and other materials published on this website belongs to the administrator or the respective rights holders.
- You may save materials for personal viewing on your own devices and share the URL of this website.
- Unauthorized reproduction, redistribution, sale of copies, false claims of authorship, tracing, removal of signatures or watermarks, and alteration or modification without permission are prohibited.
- Use in connection with NFTs or crypto assets, inclusion in asset or data collections, and registration as trademarks, designs, or similar rights are prohibited.
- Use for political or religious activities, harassment or defamation, unlawful acts, or purposes contrary to public order and morals is prohibited.
- For fan art and other subjects whose rights belong to third parties, the guidelines of the original work and the respective rights holders also apply.
02Use with Generative AI
- Works from this website may not be used as training data or datasets for generative AI, including fine-tuning, LoRA, or any other form of additional training.
- Works may not be input into image-generation AI or used for image-to-image processing, ControlNet, reference images, AI-assisted additions or conversions, or the generation of similar works.
- Automated collection of images or text for AI-related use is prohibited.
- Where individual permission has been granted, use is limited to the purpose and scope agreed upon.
03Commissions
- Requests submitted through third-party services such as Skeb are governed first by the terms and transaction conditions of those services.
- For direct requests made by email or similar means, quotations, confirmation emails, and other individual agreements take precedence over these terms.
- A commission is formally accepted once both parties have confirmed the scope, fee, delivery date, intended use, number of revisions, and other conditions, and the required payment has been completed.
- Clients must confirm that they hold the rights and permissions required for any materials or subjects they provide.
- Revisions are provided within the number and scope agreed in advance. Major redraws or changes to specifications after acceptance may incur additional fees.
- Cancellations or refunds requested by the client after work has begun may not be available depending on the progress made. If the artist cannot complete the work for reasons on the artist's side, the matter will be handled individually based on the unfinished portion.
- Copyright remains with the artist unless a transfer is agreed in writing. Please consult in advance regarding commercial use, secondary use, merchandise, streaming, advertising, or similar uses.
- Modification, redistribution, resale, false claims of authorship, and use with generative AI are prohibited unless individually permitted.
- Completed work may be published on this website, social media, or elsewhere as part of the artist's portfolio. Please notify the artist before placing the request if publication is not permitted or must be delayed.
- Editable source files and work-in-progress data are not included in the deliverables unless agreed in advance.
04Disclaimer and Changes to These Terms
- This website is not responsible for the content, safety, or continued availability of external websites accessed through its links.
- The content of this website may be changed, suspended, or discontinued without prior notice.
- These terms may be revised as necessary. Revised terms take effect when they are posted on this page.
